Sexual Orientation Discrimination Meanings:

    Discrimination against working people who identify themselves as gay, lesbian, bisexual or transgender.

    The Obama administration's Equal Employment Opportunity Commission (EEOC) has filed two lawsuits against former employees, alleging that they have been discriminated against because of their sexual orientation. Instead, the Trump administration's Department of Justice (DOJ) gave a briefing on one of the two cases. Here, the DOJ argues that the definition of gender in Title VII of the Civil Rights Act 1964 does not include discrimination on the basis of sexual orientation. In fact, gender (a term used in Title VII) and sexual orientation (a term that does not appear in Title VII) are fundamentally different. The letter argued that legislation would be needed to extend the scope of Title VII to include sexual orientation, a position opposed by the previous Obama administration.

    The Federal Court of Appeals did not agree that the prohibition of sexual discrimination under Title VII also covers sexual orientation.

    While almost half of the states (along with some cities and counties) have laws that prohibit discrimination based on sexual orientation, other states and communities do not have laws that address this issue. As a result, employers can be held liable under state or local law where federal courts have not ruled on the matter.
