  1. Type of constructive trust or implied trust (imposed by operation of law in absence of express intention of the trustor) created by the trustor that is unlawful (see void trust) or where the trust property remaining after disposal of beneficial interest goes back to the trustors estate.

  2. A trust created by operation of law in certain situations where the beneficial ownership of property is unclear.
