Definition of Past practices:

  1. Dispute resolution method used where an agreement does not address the subject matter of a dispute, or where its language is unclear or contradictory. In this method historical records are studied to find how a similar dispute was resolved. Also called established practices.

  2. Established practices sanctioned by common acceptance and use. Even if not included in an agreement, past practices are understood to be its integral part and are enforced like express terms.
